1. Introduction
Welcome to Wayt ("we," "us," "our," or "the Service"). These Terms of Service ("Terms") govern your access to and use of the Wayt website, mobile application, and related services (collectively, the "Platform").
Wayt provides a convenience service that connects customers with independent contractor waiters who wait in line at restaurants, venues, and events on behalf of customers. By accessing or using our Platform, you agree to be bound by these Terms.
Important: If you do not agree to these Terms, you may not access or use the Platform.
2. Service Description
Wayt is a technology platform that facilitates connections between:
- ✓ Customers: Individuals who want to skip waiting in line at venues
- ✓ Waiters: Independent contractors who wait in line on behalf of customers
- ✓ Venues: Restaurants, bars, events, and other establishments (partners or unlisted)
Wayt is not a restaurant reservation service, ticketing platform, or venue operator. We provide line-waiting convenience services only. Seating, entry, and service at venues are at the sole discretion of the venue.
3. Bookings & Payment
3.1 Booking Process
When you make a booking through Wayt, you are purchasing a line-waiting service, not a guaranteed reservation or table. The booking process includes:
- Selecting a venue and time
- Specifying party size and special requests
- Payment of the full booking amount
- Confirmation via SMS and/or email
3.2 Pricing
Our pricing is transparent and as follows:
All bookings include a $5 service fee. Large parties (7+ people) may incur an additional 25% surcharge, which will be disclosed before payment.
3.3 Payment
Payment is processed securely through Stripe at the time of booking. Your card is charged immediately upon confirmation. We do not store your full card information on our servers.
4. Cancellation & Refund Policy
Cancellation Tiers
To cancel a booking, use the "Cancel Booking" button in your My Bookings dashboard or contact us at support@Wayt.com or (843) 555-1234.
Refunds are processed to the original payment method within 5–10 business days.
5. User Conduct
You agree to use the Platform responsibly and in accordance with these Terms. Prohibited conduct includes:
- ✗ Using the service for illegal or fraudulent purposes
- ✗ Making bookings under false pretenses or with stolen payment methods
- ✗ Harassing or abusing waiters, venue staff, or other customers
- ✗ Attempting to bypass or manipulate the booking system
- ✗ Self-referral in the referral program (violators will be banned)
We reserve the right to suspend or terminate accounts that violate these policies.
6. Waiter Independent Contractors
Wayt waiters are independent contractors, not employees. By signing up as a waiter, you acknowledge:
- ✓ You are responsible for your own taxes, insurance, and expenses
- ✓ You set your own availability and can accept or decline jobs
- ✓ Waiter earnings: ~$72–$92 per job after platform fees (varies by job)
- ✓ Payouts are processed via Stripe within 24 hours of job completion
Waiters must maintain professional conduct, arrive on time, and communicate promptly with customers and Wayt staff.
7. Venue Partnership Program
Venues can partner with Wayt at three levels:
Wayt operates at your venue without a formal agreement. No listing, no payout.
Listed on our platform with coordination. No payout.
Everything in Partner, plus $5 automatic Stripe payout per completed booking.
Venue partners must maintain accurate hours, cutoff times, and capacity information. Wayt reserves the right to remove venues that repeatedly provide incorrect information.
8. Referral Program
Wayt's referral program allows users to earn rewards by referring new customers. Key terms:
- ✓ Earnings: 10% of platform fee per referred user's booking (typically $2/booking)
- ✓ Lifetime rewards: Earn on every booking your referral makes, not just the first
- ✓ Cashout minimum: $10 balance required for payout
- ✗ No self-referral: Creating multiple accounts to earn referrals is prohibited and will result in permanent ban
- ✗ Single-level only: No multi-level or pyramid-style referral chains
Wayt reserves the right to modify or terminate the referral program at any time. Accrued earnings will be honored for referrals made before program changes.
9. Liability & Disclaimers
9.1 Service Disclaimer
Wayt provides a line-waiting convenience service only. We do not guarantee:
- Seating, entry, or service at any venue
- Specific wait times (estimates are provided in good faith)
- Venue availability (venues may close, fill up, or change policies)
- Quality of food, drinks, or experience at partner venues
9.2 Limitation of Liability
To the maximum extent permitted by law, Wayt's liability is limited to the amount you paid for the booking in question. We are not liable for:
- Consequential, incidental, or punitive damages
- Lost time, missed events, or disappointment
- Venue closures, overbookings, or policy changes
- Actions or negligence of waiters, venues, or third parties
9.3 Indemnification
You agree to indemnify and hold harmless Wayt, its contractors, partners, and affiliates from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.
10. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using Wayt, you consent to the practices described therein.
We collect: name, phone number, email, payment information, booking history, and referral data. We share information with waiters (for coordination) and venues (for seating) only as necessary to fulfill bookings.
11. Changes to Terms
Wayt reserves the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Platform at least 7 days before they take effect.
Continued use of the Platform after changes constitutes acceptance of the new Terms. If you do not agree, you must stop using the Platform.
